TERMS AND CONDITIONS 2012

 

1.     PRICES

The prices contained in any estimate, quotation, or price list are based on conditions ruling at the date therein, and are fixed for a period of three months, save for any variation by statute or regulation outside the control of Evolution Training Limited. All prices quoted are exclusive of VAT, which will be charged at the rate in force at the time of delivery by Evolution Training Limited

2.     SCHEDULED OPEN COURSES

2.1   Booking

 

2.1.1      Places on scheduled courses are secured by: Full payment, 25% non-refundable deposit or Purchase order

2.1.2      Please note that accommodation and meals are not included.

2.1.3      We reserve the right to cancel the course if there is insufficient demand

2.1.4      Full payment must be received prior to the first day of the course, otherwise we reserve the right to release your place

2.1.5      If you are being funded by an organisation an official Purchase Order must be provided for the full amount

2.1.6      We will invoice your organisation directly six weeks prior to the course

2.1.7      We do not store credit card details nor do we share customer details with any 3rd parties

2.1.8      I agree that film and images of me during Evolution Training Limited events may be used for marketing purposes

 

2.2    Cancellations

 

2.2.1      Cancellations must be received in writing by post or email

2.2.2      Cancellations can be accepted up to four working weeks prior to the start of the course and the 25% deposit will be forfeited

2.2.3      Cancellations made after this time will be charged in full

2.2.4      At the discretion of Evolution Training Limited, another delegate may take your place, or you may be offered the opportunity to transfer to an alternative course

2.2.5      Alternative course places will only be offered once and failure to take-up this offer will result in you forfeiting the full cost of the course

2.2.6      If you are unable to attend the course due to circumstances beyond your control, you will be offered the chance to transfer to an alternative course, at the discretion of Evolution Training Limited

 

3.     COMMISSIONED WORK

 

3.1   Commissioned work booking

Commissioned work contracts are valid on receipt of a purchase order or full payment

3.2   Rescheduling commissioned work

Any change to the ordered start date or work ordered with less than eight weeks, will be commenced either on the requested date or as soon as resources become available

 

3.3   Commissioned work cancellations

In the event of cancellation or rescheduling of commissioned work the following charges will apply:

·      Less than 8, but more than 4 weeks before the commencement date: 60% of the full fee together with all unrecoverable costs

·      4 weeks or less before the commencement date or once the service has been initiated: 100% of the full fee

3.4    Payment terms

Payment is due within 14 days of the invoice date and interest is charged on late payments at base rate plus 4%

 

4.     CANCELLATIONS BY EVOLUTION TRAINING

Evolution Training Ltd reserves the right to provide an alternative trainer, rearrange or cancel

4.1  We will notify you at the earliest possible opportunity and every effort will be made to accommodate a transfer to alternative dates, otherwise a full refund will be offered

4.2  The liability of Evolution Training Limited shall be limited to the provision of training only

4.3  In the event of the trainer’s illness, accident, or any other circumstance which prevents the company from providing the training course on the dates specified then no liability shall be accepted for any expenses thereby incurred by the purchaser

 

5.     PAYMENT

Payment may be made by: BACS (20-20-62 10040118 Evolution Training Ltd, Reference = Invoice/Account no.), Debit Card or Credit Card

 

6.     Disclaimer

6.1  All delegates should be physically and psychologically fit to fully participate in the training and the onus is on the client to ensure this

6.2  The information contained and presented in this training is useful in creating rapid and lasting change

6.3   Evolution Training Ltd is responsible for the quality, delivery and content of the training, and does not accept any liability for how the methods, tools and models are used thereafter

 

7.     COPYRIGHT

Any material, recorded or written, included as part of this training may not be used or copied without obtaining prior written permission from Evolution Training.

 

8.     JURISDICTION

The law of England and Wales will apply to any contract entered into with Evolution Training Ltd
